1. Overview. A Night in Monaco is a charitable fundraiser produced by the Joe & Nora Barbat Family Foundation ("we," "us"). Proceeds benefit the Children's Foundation of Michigan and the Joe & Nora Barbat Family Foundation. By placing a bid, you agree to these Terms.
2. Eligibility. You must be 18 years or older and a legal resident of Michigan. Employees and immediate family of the organizers may be restricted from participating where required by law.
3. What a bid is. Each bid is a fixed donation of $30 and constitutes one entry into the drawing for the item you select. You may place as many bids as you wish on any item by adding them to your cart and checking out. Payment is processed securely by Stripe. Placing a bid is a charitable contribution, not the purchase of goods.
4. All bids are final and non-refundable. Every bid is a non-refundable donation, whether or not you win. We do not issue refunds for bids under any circumstances except a cancellation of the raffle under Section 11.
5. Blind bidding. Bidding is blind. You will not see how many bids an item has received, or any other participant's bids.
6. How winners are determined. Each bid constitutes one entry into a random drawing for the associated item. After bidding closes, one entry per item is selected at random, and the participant associated with that entry's email address wins that item. Placing more bids increases the number of entries you have and therefore your probability of winning, but does not guarantee a win. Entries are associated with the email address used at checkout; you must use the same email each time you bid for your entries to be attributed to you.
7. Bidding close. Bidding closes at 12:00 AM Eastern Time on August 29, 2026. Bids placed or completed after that time are not entered into the drawing.
8. Winner notification and prize claim. Winners are contacted by email after the drawing. You are responsible for providing a valid email address and monitoring it. You must respond and complete any redemption steps set by the sponsoring donor within 30 days of notification. Prizes not claimed within 30 days of notification are forfeited and may be awarded at our discretion.
9. Prizes. Prizes are provided by third-party sponsors and are awarded as-is, without warranty. Stated retail values are estimates for reference only and are not guarantees of resale or cash value. Prizes have no cash value and are non-transferable unless stated. Redemption terms, expiration dates, and conditions are set by the sponsoring donor. Any taxes or fees arising from a prize are the sole responsibility of the winner. We do not guarantee that any bid will result in a win.
10. Payment processing. Payments are processed by Stripe, subject to Stripe's terms. We do not store your full payment card details.
11. Changes and cancellation. We may modify, suspend, or cancel the raffle if required by law or circumstances beyond our control. If the raffle is cancelled, refunds will be processed in accordance with Stripe's refund policy. No refunds are issued under any other circumstances.
12. Limitation of liability. To the fullest extent permitted by law, the Joe & Nora Barbat Family Foundation, the Children's Foundation of Michigan, and the sponsors are not liable for any indirect or consequential damages arising from participation, the raffle, or any prize.
13. Governing law. These Terms are governed by the laws of the State of Michigan, Oakland County.
